Heinz sues Figueroa Brothers over shape of bottle




The H.J. Heinz Company has sued Figueroa Brothers Inc. in federal court in Dallas,

the

Dallas Morning News

reported.

Heinz accuses Figueroa Brothers, the makers of Melinda’s Habanero Ketchup, of trademark infringement concerning the shape of the Melinda’s bottle.

“The battle’s over the bottle, not the product inside it,” the article noted.

Figueroa Brothers, of Dallas, is owned and operated by CEO Greg P. Figueroa and president David O. Figueroa Jr. The company’s first product, Melinda’s Original Habanero Pepper Sauce, debuted in 1989. The brothers also have developed private brands for more than 100 companies, according to the company’s website. The brothers also run a creative services division, Fig Creative Studio, based in Louisiana. (Source:
